BY USING THIS WEBSITE YOU ACCEPT THIS TERMS OF USE AGREEMENT, WITHOUT LIMITATION OR QUALIFICATION AND UNDERSTAND THAT THIS IS A LEGAL AGREEMENT BETWEEN YOU, the “USER”, AND RECREATION NOVA SCOTIA.  

Purpose

NS Connect.ca is an online database where individuals, groups and families can navigate sport, recreation and physical activity opportunities in Nova Scotia. NSConnect.ca was established for the purpose of increasing the accessibility of information on active living and recreation opportunities for Nova Scotians. The content on any NSConnect.ca website (the “Website”) is for information purposes only and is made available solely for the private recreational use of individuals and groups. Any commercial use by third parties, including republishing, data mining and inclusion of information obtained from the website in other documents or internet-based services for the purpose of profit is strictly prohibited.

While Recreation Nova Scotia and its Regional Partners are committed to providing information that is correct, accurate, and timely, the Website and content are provided “as is”.  Recreation Nova Scotia makes no representations or warranties, express or implied, regarding the Website and the integrity of its content including, without limitation, no representation or warranty that (i) the content contained in or made available through the Website will be fit for a particular purpose, (ii) the Website or content will be accurate, complete, current, reliable, or timely, (iii) that the operation of the Website will be uninterrupted or error-free, (iv) that defects or errors in the Website or the content, be it human or computer errors, will be corrected, (v) that the Website will be free from viruses or harmful components, and (vi) that communications to or from the website will be secure and/or not intercepted. Information is curated by Regional Partners and is not independently verified for completeness or accuracy. Recreation Nova Scotia only vets the information to determine that, generally, the content is consistent with the purpose of the Website.

Inclusion

Through the Website, Recreation Nova Scotia and its Regional Partners collect, maintain, and disseminate information about sport, recreation, and physical activity opportunities in Nova Scotia.  Recreation Nova Scotia does not routinely monitor the quality of the programs, services, facilities, parks, trails, space, events or other information listed. Inclusion of a program, service, facility, park, trail, space, or event, on the Website is not a recommendation, endorsement or comment on the quality of program, service, facility, park, trail, space, or event, nor does exclusion indicate lack of endorsement.

Exclusion

Recreation Nova Scotia reserves the right to remove any information from the Website which, in its sole discretion, it determines to be erroneous, inaccurate, misleading (intentionally or inadvertently), inconsistent with the purpose of the Website, offensive, unlawful, or in breach of this Terms of Use Agreement.

Specifically, the Website will not contain any information related to programs, services, facilities, parks, trails, spaces or events that promote, or involve, alcohol or gambling as the main focus of the activity.

Limitation of Liability

Use or reliance on Website materials and information, including any embedded links, is strictly at the risk of the user. In no event shall Recreation Nova Scotia  be liable whatsoever for damages of any kind arising out of,  or in connection with, the use of the Website or reliance on the information available on the website.

Prohibited Use

The User shall not damage, disable, or threaten the Website, or use the Website in any way that could damage, disable, or threaten the Website.

The User is responsible for all of their actions related to the Website and assumes all liability associated with, and/or damages arising from, the use of the website.

Privacy

Recreation Nova Scotia may record Website traffic, including user addresses, for statistical and program performance assessment and promotion, and may send electronic communications to users accordingly.

Recreation Nova Scotia will not publish, sell, rent or distribute commercially personal information concerning users of the Website, including electronic addresses of users and will keep confidential personal information in accordance with this Terms of Use Agreement.

External Links

At times, links to external websites may be provided on the Website to provide further sport, recreation and physical activity resources to the User. These external links are not created, or managed by Recreation Nova Scotia. External links include, but are not limited to maps, organization websites, or other databases. Recreation Nova Scotia does not make any representation or warranty as to the accuracy, reliability, legality, suitability, security, or integrity of the external websites. The User assumes any and all liability associated with accessing external websites contained on the Website. Furthermore, in providing links to external websites, Recreation Nova Scotia is not acting as publisher or disseminator of any of the material contained on the external websites.  

Termination

Recreation Nova Scotia reserves the right to remove and/or disable access to the Website, with or without notice, for any User that violates this Terms of Use Agreement or does anything that Recreation Nova Scotia determines, in its sole discretion, to be threatening, misleading (intentionally or inadvertently), inconsistent with the purpose of the Website, offensive, or unlawful.  

Governing Law

This Terms of Use Agreement shall be governed by the laws of the Province of Nova Scotia.

General Provisions

If any provision of this Terms of Use Agreement is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of this Agreement and shall not affect the validity and enforceability of any remaining provisions.

No waiver, express or implied, by Recreation Nova Scotia, of any breach of or default by User under this Terms of Use Agreement will constitute a continuing waiver of such breach or default or be deemed to be a waiver of any preceding or subsequent breach or default.

Recreation Nova Scotia reserves the right to revise from time to time in its discretion, exercised reasonably, this Website Terms of Use, and it is the responsibility of persons accessing the website to ensure familiarity with the policy in force at the time of access.
